Electronic Signatures in Global and National Commerce Act (ESIGN)
is a federallaw passed by the U.S. Congress in 2000. The bill lays
out guidelines for the other states thathave individual electronic
signature laws. Formerly, clear federal laws on electronic
signatureswere missing in the U.S. statutes. ESIGN states that
electronic signatures are legal, valid, andenforceable just as
their paper counterparts.For this reason, all signatures, whether
electronic or in hard copy, should undergo thesame scrutiny.
However, there is supposed to be evidence of consent from the
signatory that theyagreed to use electronic signatures. ESIGN has
